材料一:元廷制订了一整套比较严密的政策。将行省权力规范在大而不专的模式内。行省实行群官负责和圆署会议制,行省多名官员中,常常是蒙古人、色目人、汉人交参任用。重要政务“事从公议”,而且常有“众论不齐”的情况。成宗朝前后。行省官朝觐述职和不定期迁调,朝廷遣官钩考、巡察等,或经常举行,或成为定制。行省路以下官吏的铨调升用,由朝廷三年一次遣使举行。元代行御史台及廉访司既注意对一般地方官府的普遍监察,更把行省当做地方监察的重点对象。行省区划主要以中央军事控制为目的,不惜打破自然地理界限,不顾区域经济联系,人为地造成犬牙交错和以北制南的局面。从而使行省官失去了扼险而守、割据称雄的地理条件。

材料二:美国1787年宪法第六条规定:本宪法及依本宪法所制定之合众国法律,以及合众国已经缔结及将要缔结的一切条约。皆为全国之最高法律;每个州的法官都应受其约束,任何一州宪法或法律中的任何内容与之抵触时,均不得有违这一规定。前述之参议员及众议员,各州州议会议员,合众国政府及各州政府之一切行政及司法官员,均应宣誓或誓愿拥护本宪法。美国1787年宪法及其修正案第十条规定:本宪法所未授与合众国或未禁止各州行使之权力,均由各州或由人民保留之。美国内战结束后,国会通过宪法第十三条和第十四条修正案,规定:任何一州,都不得制定或实施限制合众国公民的特权或豁免权的任何法律。
